Son of Thomas Nepean Upton and Annie Eliza Upton nee Beatus of Ray Street, Lithgow, NSW. Brother to Thomas Charles Egbert Upton MM & Bar who returned to Australia on 25 October 1919 having served with the 12th and 14th Machine Gum Companies

16 November 1916 - enlisted at Sydney, NSW, with the 2nd Battalion and with the rank of Private

8 March 1918 - transferred to the 12th Machine Gun Company

11 June 1918 - transferred to the 4th Machine Gaun Battalion with the rank of Corporal

18 July 1919 - commenced return to Australia aboard HT Takada disembarking on 7 September 1919 at Melbourne for onward travel to Sydney.

Medals: British War Medal, Victory Medal

8 October 1919 - discharged at the 2nd Military District

During 1932c Vivian married Virginia Alberta Wright in Sydney, NSW

During WW2 Vivian was employed at Small Arms Factory in Lithgow.
