KILLING CHARGE
OVER GUN FAILS
Mervyn David Henry, 29, soldier, was found not guilty in the Criminal Court yesterday of having unlawfully killed Arthur Noel Ellis, at a military camp, on July 6 last.
Mr. Justice Macrossan discharged Henry, who had denied the charge. The Crown Prosecutor (Mr. J. A. Sheehy) said that Henry was a lieutenant, and Ellis a sergeant in a  military unit. They were friends. On July 6 they were talking together, about 8ft. apart. Henry was preparing to go on duty, and while he was handling a service revolver it went off and a bullet entered Ellis' heart and killed him.
Mr. Sheehy added that it was not alleged that Henry intended to kill Ellis, or to do him grievous bodily harm, but it was alleged that he was negligent, and did not exercise a  proper standard of care in using a lethal weapon.
Mr. E. J. D. Stanley (instructed by Mr. J G. Drake) appeared for Henry.
