SYDNEY, Tues.— Will of a dead airman who left his estate to a wife who apparently does not exist was produced in the Probate Court today. George Herbert Harrison (29) before his death lived with his mother at Wahroonga. He was employed as a clerk in the Premiers' office. He died on January 14, 1944, His will, dated June 1, 1943, said: 'I appoint my wife, Mary Jane Harrison, executrix of my will and I give to my said wife the whole of my estate both real and personal.'
Estate was valued at £380.
Philip Neale Harrison, of Armidale, brother of the dead man, applied to the Court for letters of administration on the ground that his brother had died a bachelor and intestate. DEAD AIRMAN'S
WILLCHALLENGED
THE will of a member of a R.A.A.F. air-crew, leaving his estate to a wife who could not be traced, and of whom there was no record, was contested in the Probate Court today.
PHILLIP NEALE HARRISON, Of Armidale, applied for Letters of Administration of the will of George Herbert Harrison (29), R.A.A.F. who died on January 14. 1944.
In a will dated June 1. 1943, Harrison appointed his "wife. Mary Jane Harrison, 40 Bundarra Ave., Wahroonga," his executrix and left her his entire estate of £380. Harrison based his application on the grounds that his brother had died a bachelor and intestate. In affidavit. Phillip Harrison stated that before enlistment his brother had lived with his mother, five brothers and three sisters. He had lived with no one else.
No Records
Phillip Harrison alleged that there was no such person as Mary Jane Harrison living at 40 Bundarra Ave., Wahroonga and indeed the only person bearing that name had been Harrison's paternal grandmother, who had died many years before his birth. In a further affidavit Harrison said that he had searched the records in New South Wales and South Australia — the only places his brother had ever lived — and had found no trace of any marriage contracted by his brother.
Mr. Justice Nicholas stood the matter over generally so that Air Force witnesses now believed to be outside Australia, could be traced.
