Max was the fourth of ten children of Henry George Hay (born 1887 at Lady's Bay in Tasmania) and Hilda May Griggs (born 1886 in Franklin, Tasmania). Henry, an Orchardist, and Hilda married in 1909 in Franklin, Tasmania, where they raised their family.

Max was a Lorry Driver at Franklin in Tasmania when he enlisted in the Australian Army in October 1939 and was a Sergeant (Service No:TX41) attached to 2/12th Infantry Battalion when he took his Discharge in October 1945. Brothers Henry Rex Hay (Service No:TX4328) and Roy (Jerry) Hay (Service No:TX10231) also served in WWII.

In March 1945 Max married Joyce Isabel Crole (born 1919 at Elsternwick in Victoria). Joyce had been a Saleswoman at Ballarat in Victoria before enlisting in the Army in Melbourne, Victoria. Joyce served as a Driver (Service No:VF395994) with L HQ Car Coy from 26 November 1942 to 10 October 1945.

Max and Joyce settled in Franklin, Tasmania where Max was a Lorry Driver, before relocating to Table Cape and working as a Farmer and a Watchman.

Max died in 1986 and Joyce in 1999.
