Herbert was married to Gladys and had an infant daughter when he enlisted from 114 Elizabeth Street, Launceston, Tasmania.

He suffered a shrapnel wound to the face on the 13 November 1916 near Flers and died of his wounds nine days later.

His older brother, 3719 Pte. Robert James Duffy 1st Battalion AIF, had been killed in action 3 months before, at Pozieres on 19 August 1916, aged 27.

Their parents were Patrick and Bridget Agnes Duffy (Duffey). The father had passed away in 1901 and the mother Bridget died in 1918.
