One of three brothers (Frank and John) who served in WWII, Lieutenant Mervyn Ernest Rutherford (Service Nos:Q9234/QX44163) initially served in the ACMF as a Gunner, Bombardier, Sergeant and Warrant Officer II, and was a Lieutenant attached to 5 Field Regiment RAA on 22 September 1941 when he enlisted in the AIF. Lieutenant Rutherford served in Darwin, Northern Territory in 1943, and was attached to 5 Field Regiment at Termination of Appointment on 9 August 1944.

Third of four children, Merv was born in Brisbane QLD in 1918 to John David Rutherford (b1892 in Brisbane, QLD) and Caroline Le Breton (b1893 in Brisbane, QLD). John (a Plumber) and Caroline married in 1915 in Brisbane, where they settled and raised their family and John worked as a Plumber and Motorman.

Merv was a Bootmaker in Brisbane, where in 1941 he married Edna Mavis Wright (b1920 in Brisbane, QLD). Following his Discharge from the Army, Merv and Edna settled in Brisbane, where they raised their family and Merv was a Slipper Maker and Poultry Farmer. By 1949 Merv and Edna had moved to Woolooga via Gympie, where Merv was a Dairy Farmer, and in the 1950s/1960s Merv and his family lived in Brisbane, and then Grantham on the Darling Downs (where Merv was a Dairy Farmer). In the late 1960s Merv and Edna returned to Brisbane, where Merv was a Storekeeper and Porter, before retiring to Bribie Island. Merv and Edna both died in Ipswich - Merv in 1998 and Edna in 2008.
